On October 12, 2010, New York State's "No Fault" law went into effect. Under this law, a spouse whose marriage has been "broken down irretrievably for a period of at least six months", can now obtain a divorce without the requirement of proving fault by the other party (such as cruel and inhuman treatment, abandonment, constructive abandonment, or adultery) which often meant extended and expensive litigation. Now, the courts and the spouses no longer have to waste resources litigating whether a divorce should be granted, but will now be better able to focus resources and attention on issues such as the welfare of the children, equitable distribution of marital assets and debts and other economic and fairness concerns. This law will also provide some relief for those living in relationships which failed through no one's fault.
To assist the spouse who has little or no income, during the course of the litigation, New York State also passed a law providing for temporary maintenance (spousal support) and temporary attorney's fees. These laws will ensure that all parties have financial support and legal representation while preparing their cases for hearings and trial, and will prevent situations where the monied spouse could force an unfair settlement by withholding funds from the other party.
